When using this website, you consent to the educational, ethical, and Client-Focused Service values of BookYourAppt.com, BookYourAppt.com, and the associated independent financial professionals (an “Affiliate”). BookYourAppt.com may terminate your listing at any time if you:
1) Have any serious allegation, marketplace complaint, or online record of moral, ethical, personal, or professional misconduct. Instances of misconduct include dishonesty, misrepresentation of products, client theft, misappropriation of client funds, fraud, state or federal criminal acts, and/or other behaviors against the standards of good business practice as accepted by the insurance, advisory, and financial services industries.
2) Fail, refuse, or neglect to conform your personal and/or professional behavior in line with the educational, ethical, and Client-Focused Service values of BookYourAppt.com, BookYourAppt.com, and the associated independent financial professionals (an “Affiliate”). Under these conditions, termination of a listing will commence without any form of remuneration.
INTELLECTUAL PROPERTY RIGHTS
Other than content you own, which you may have opted to include on this Website, under these Terms, BookYourAppt.com owns all rights to the intellectual property and material contained, and/or published by BookYourAppt.com. All such rights are reserved.
USE OF COMMUNICATION SERVICES
The BookYourAppt.com Website may contain customer relationship manager (“CRM”) services, bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
Restrict or inhibit any other user from using and enjoying the Communication Services.
Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
Violate any applicable laws or regulations.
BookYourAppt.com has no obligation to monitor the Communication Services. However, BookYourAppt.com reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. BookYourAppt.com reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.
BookYourAppt.com reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in BookYourAppt.com's sole discretion.

TERMINATION/ACCESS RESTRICTION

Bookyourappt.com reserves the right, in its sole discretion, to terminate your access to the Bookyourappt.com Website and the related services or any portion thereof at any time, without notice.
GENERAL NOTICE
To the maximum extent permitted by law, this agreement is governed by the laws of the State of Tennessee, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in Davidson County, Tennessee, U.S.A. in all disputes arising out of or relating to the use of the Bookyourappt.com Website. Use of the Bookyourappt.com Website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Bookyourappt.com as a result of this agreement or use of the Bookyourappt.com Website. Bookyourappt.com performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Bookyourappt.com right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Bookyourappt.com Website or information provided to or gathered by Bookyourappt.com with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Bookyourappt.com with respect to the Bookyourappt.com Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Bookyourappt.com with respect to the Bookyourappt.com Website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English.
CONTENT USAGE BY FINANCIAL PROFESSIONALS
Bookyourappt.com listings and listings information may not be substituted at any point for anyone other than the Designated Financial Professional for each individual listing. The Affiliate can terminate or suspend the listing at any time.
If an individual listing is canceled for a designated financial professional within 12 calendar months of the date of affiliation, any renewal of a listing for that designated financial professional will be subject to a new Affiliation Agreement with Bookyourappt.com once the 12 calendar months are satisfied. Once an individual listing is canceled for a designated financial professional, the designated financial professional must cease use of Bookyourappt.com materials and content in their business. Continuing use of Bookyourappt.com consumer materials and content after a listing cancellation will subject the parties using Bookyourappt.com materials under violation of these terms and conditions to possible litigation.
CONTENT USAGE BY THIRD-PARTY FINANCIAL COMPANIES
Only with contractual agreement with Bookyourappt.com, including but not limited to written authorized permission by Bookyourappt.com and agreed-upon terms with Bookyourappt.com, may financial firms, insurance agencies, field marketing organizations, independent marketing organizations, insurance carriers, broker/dealers, registered investment advisors, and other third-party financial companies use Bookyourappt.com and any of its branding concepts, consumer guides, articles, handouts, brochures, and any other content for Bookyourappt.com. Listings by third-party financial companies for their appointed financial professionals are available for an annual basis only. Terms subject to change after 12 calendar months from date of applied listing. Each listing may only be used for one designated financial professional and is not transferable.
Bookyourappt.com listings and listings information may not be substituted at any point for anyone other than the designated financial professional for each individual listing. The Affiliate can terminate or suspend the listing at any time, and without any recourse.

Continuing use of Bookyourappt.com consumer materials and content after a listing cancellation will subject the parties using Bookyourappt.com materials under violation of these terms and conditions to possible litigation.
GEOTARGETING SERVICES – CANCELLATION RIGHTS
One paid service that our Authorized Marketing Associate or Authorized Marketing Suppliers (collectively “Authorized Marketing Service Provider”) offers to Bookyourappt.com Affiliates, is geo targeted ad placements on select pages of BookYourAppt.com. This is done on a by-territory basis. Each Authorized Marketing Service Provider reserves the right to cancel an Affiliate’s active territory within its geotargeting services in accordance with the terms of such providers Service Agreement. Furthermore, each Marketing Service Provider reserves the right to then offer this territory to another Affiliate.
LEAD GENERATION PROGRAMS – PARTICIPATION RIGHTS
One paid service that our Authorized Marketing Associate or Authorized Marketing Supplier (collectively “Marketing Service Providers”) offers to Bookyourappt.com Affiliates, is lead generation programs. Any results from these programs are not guaranteed. Financial professionals participating in this program have the responsibility of following up with these leads personally and closing sales. Participating financial professionals are subject to the terms and conditions of the Authorized Marketing Service Provider’s Service Agreement. Each Authorized Marketing Service Provider reserves the right to cancel an Affiliate’s participation within its lead generation programs in accordance with the terms of Service Agreement and at its sole discretion.
